Terms of Use
1. Acceptance of These Terms
These Terms of Use & Service (“Terms”, “Agreement”) are a legally binding contract between MyTestPro LLC (“MyTestPro”, “we”, “us”, “our”) and you (“you”, “user”), governing your access to and use of MyTestPro websites and subdomains (including lovefactor.mytestpro.com), apps, and all related content, features, tools, reports, downloads, and purchases (collectively, the “Service”).
By accessing or using the Service (including clicking Start quiz, Continue, Buy, Get results, or similar), you agree to these Terms and to our Privacy Policy and Cookie Policy (together, the “Policies”). If you do not agree, do not use the Service.
Age & capacity. You must be 18+ (or the age of majority where you live) and able to form a binding contract.
Updates. We may change these Terms at any time by posting a revised version on the Service. Changes take effect upon posting unless a later date is stated. Your continued use constitutes acceptance.
2. What MyTestPro Provides (Nature of the Service)
MyTestPro operates online assessments (e.g., attractiveness/relationship, energy, money mindset, IQ/EQ) and may provide results such as scores, benchmarks, insights, guides, and downloadable reports. Certain features are free; others are paid (“Paid Services”), including one-time purchases (e.g., a personalized report) and/or subscriptions with ongoing access to gated content or materials. Access windows to downloads or gated content may be time-limited and will be indicated at or before checkout.
Important Notices (No Professional Advice)
- The Service is for information, self-reflection, education, and entertainment only.
- We do not provide psychotherapy, medical care, psychiatric diagnosis/treatment, financial, legal, or other professional advice.
- Results vary by individual and context; any testimonials or examples are illustrative only.
- If you are in crisis or believe you may harm yourself or others, seek immediate professional help.
3. Accounts & Security
You are responsible for your credentials and all activity under your account. Keep them confidential and notify us promptly of any unauthorized use. You may not sell, transfer, or share your account.
4. Pricing, Offers, Trials & Auto-Renewals
4.1 Pricing & taxes. Prices, features, and availability are shown at checkout and may change. Taxes or other governmental charges may apply.
4.2 One-time purchases. Some offerings are billed once and delivered digitally. Delivery may begin immediately after purchase.
4.3 Subscriptions. If you buy a subscription, it auto-renews at the then-current rate until you cancel. We may offer trials or discounted intro periods that convert to standard rates unless you cancel before the trial ends. Details appear at purchase. We may individualize promotions; they are time-limited, non-transferable, and do not apply retroactively.
4.4 Cancellation. You can cancel subscriptions any time by contacting support@mytestpro.com. Cancellation takes effect at the end of the current billing cycle; access typically remains until then.
4.5 Price changes. We may modify subscription pricing or package features prospectively; we’ll provide reasonable notice by posting updated pricing on the Service and/or in your account/receipt stream.
5. Payments & Payment Processors
We use third-party payment processors to accept payments. By purchasing, you authorize us and our processors to charge your payment method for purchases, renewals, taxes, and fees. We may retry failed payments and request updated payment details from you or your provider. We are not responsible for processor errors or outages.
6. Refunds, Withdrawals & Region-Specific Rights
6.1 Default policy (company-protective). All purchases are final and non-refundable once delivered/activated, unless (a) a specific money-back promise is explicitly displayed at your checkout for that offer, or (b) a refund is required by applicable law. If a guarantee is shown at purchase, follow the instructions in your receipt and contact support@mytestpro.com within the stated window.
6.2 EU/UK digital content withdrawal. If you are in the EU/UK, you typically have 14 days to withdraw from a distance contract; however, you expressly consent to immediate performance of digital content/services and acknowledge you lose the right of withdrawal once delivery/performance begins (e.g., when report access or gated content is provided).
6.3 Japan. Under the Consumer Contract Act, you may request a refund within 8 days if you have not accessed the digital content. If accessed, refunds are generally limited to defective/undelivered service where required by law.
6.4 South Korea. Under the Act on the Consumer Protection in Electronic Commerce, you may cancel within 7 days unless digital content has been accessed/provided, except where the service was defective or unavailable.
6.5 Brazil. Under the Consumer Defense Code, you may withdraw within 7 days from online/away-from-premises purchases; amounts paid during the reflection period are refunded as required by law.
6.6 Australia/Canada & others. You may have non-excludable statutory guarantees or cooling-off rights. Nothing in these Terms limits mandatory consumer rights.
7. Chargebacks & Billing Disputes
Contact support@mytestpro.com first for billing questions. You agree not to make unfounded or fraudulent chargebacks. We may suspend access during investigation and you agree to cooperate. If your actions trigger processor penalties, retrieval fees, fines, or excess dispute ratios, you agree to reimburse us.
8. Acceptable Use & Prohibited Conduct
You agree not to: (a) use the Service unlawfully; (b) scrape, crawl, or bulk-export content/data; (c) copy, modify, reverse-engineer, or create derivative works from the Service or reports; (d) interfere with or bypass security; (e) infringe IP or privacy rights; (f) harass, harm, or exploit others; (g) use the Service for professional counseling/clinical purposes; (h) resell access without permission; (i) upload malware; (j) use automated means except as we expressly allow.
We may monitor or moderate, but are not obligated to do so.
9. Intellectual Property; License to You
All Service content—including questions, scoring logic, designs, text, graphics, trademarks, and reports—is owned by MyTestPro or its licensors and protected by IP laws. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. No other rights are granted.
Your Inputs & Feedback (License to Us)
You retain rights in your quiz answers, text inputs, and feedback. You grant MyTestPro a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, analyze, adapt, and create de-identified or aggregated derivatives from your inputs to operate, maintain, protect, and improve the Service and develop new offerings, consistent with our Policies. We have no confidentiality obligation regarding unsolicited suggestions; we may use them without compensation.
10. Privacy & Electronic Communications
Use of the Service is subject to our Policies. By using the Service, you consent to receiving transactional communications (e.g., receipts, account notices). Marketing communications are opt-in/opt-out as permitted by law. Carrier/data rates may apply.
11. Availability; Changes; Beta Features
The Service may be unavailable, interrupted, or modified at any time (maintenance, upgrades, outages). Features may be added, changed, or discontinued without notice. Beta or trial features are provided “as is.”
12. Suspension & Termination
We may suspend or terminate access immediately for any breach, suspected fraud/abuse, legal/compliance reasons, non-payment, chargeback activity, risk control, or if required by partners or regulators. You may stop using the Service at any time. Sections intended to survive termination do so.
13. Export, Sanctions & Geographic Restrictions
You represent that you are not located in, and will not access or use the Service from, any jurisdiction subject to comprehensive sanctions; that you are not on any sanctions list; and that you will comply with applicable export, sanctions, and embargo laws.
14. Disclaimers (Strong Company Protection)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE—INCLUDING QUIZZES, SCORES, BENCHMARKS, REPORTS, GUIDES, DOWNLOADS, LANDING-PAGE CLAIMS, AND ANY STATISTICS—IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RESULTS, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
ANY MATERIAL ACCESSED THROUGH THE SERVICE IS AT YOUR OWN RISK; YOU ARE RESPONSIBLE FOR ANY RESULTING DAMAGE OR DATA LOSS.
15. Limitation of Liability (Strong Company Protection)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTESTPRO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES (INCLUDING LOST PROFITS, REVENUE, GOODWILL, OR DATA; BUSINESS INTERRUPTION; OR COVER/REPLACEMENT COSTS), EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD IS LIMITED TO THE LESSER OF:
(a) THE AMOUNT YOU PAID TO MYTESTPRO FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE FIRST EVENT GIVING RISE TO LIABILITY, OR
(b) USD 50.
Some jurisdictions do not allow certain exclusions or limits; where prohibited, we limit our liability to the maximum extent permitted by law.
One-year limitation period. ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES OR IT IS PERMANENTLY BARRED.
16. Indemnification
You will defend, indemnify, and hold harmless MyTestPro and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Service; (b) your breach of these Terms or Policies; (c) your violation of law or third-party rights; or (d) disputes, chargebacks, penalties, or assessments caused by your conduct.
17. Dispute Resolution — Mandatory Arbitration; No Class Actions
Informal resolution first. Before filing a claim, email support@mytestpro.com with a brief description of the dispute. We will try to resolve it within 60 days.
Binding arbitration. If not resolved, all disputes (except for IP injunctive relief and qualifying small-claims matters) will be finally resolved by binding arbitration on an individual basis:
- U.S. residents: arbitration administered by JAMS under its rules (Streamlined for claims ≤ USD 250,000; otherwise Comprehensive).
- Non-U.S. residents: arbitration administered by the LCIA under the LCIA Rules.
The arbitrator will apply Delaware law (U.S. residents) or English law (non-U.S. residents) consistent with these Terms. Either party may seek injunctive relief in court for IP misuse. Small-claims court actions may proceed in such court.
No class actions; no representative proceedings; jury waiver. YOU AND MYTESTPRO WAIVE ANY RIGHT TO CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDINGS AND TO A JURY TRIAL.
Arbitration opt-out. You may opt out of arbitration/class waiver within 30 days of first use of the Service by emailing support@mytestpro.com with subject line “ARBITRATION OPT-OUT”, your full name, and a clear statement that you opt out. If you opt out, MyTestPro is not bound by this arbitration clause with you.
18. Governing Law & Venue
Except as otherwise provided above, these Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts rules. For any non-arbitrable claims, you consent to the exclusive jurisdiction and venue of the state and federal courts in Delaware.
19. Electronic Signature & Records
By clicking buttons labeled Start quiz, Continue, Buy, Get results, Pay, or similar, you agree your action constitutes a legally binding electronic signature and that we may provide records electronically (including under the U.S. E-Sign Act and similar global laws). You also consent to immediate performance of digital content where applicable.
20. Third-Party Links & Services
The Service may link to third-party sites or services. We are not responsible for their content, terms, policies, or availability. Use them at your own risk.
21. IP Complaints
To report alleged infringement, email support@mytestpro.com with: (a) your physical/electronic signature; (b) identification of the work; (c) identification and location (URL) of the material; (d) your contact details; (e) a good-faith statement; and (f) a statement under penalty of perjury that you are the rights holder or authorized agent.
22. Miscellaneous
- Entire agreement. These Terms + Policies are the entire agreement and supersede prior agreements regarding the Service.
- No waiver. Failure to enforce is not a waiver.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- Assignment. You may not assign without our consent; we may assign these Terms.
- Force majeure. We are not liable for delays/failures due to events beyond reasonable control.
- Headings. For convenience only.
- Language. These Terms are in English; translations are for convenience only. The English version controls.
